**1. Introduction**

Welcome to Gigcer, a platform connecting freelancers and clients for various services. By using Gigcer, you agree to these Terms and Conditions. Please read them carefully.

**2. Definitions**

- **"Platform"** refers to the Gigcer website and app.

- **"User"** refers to anyone who accesses or uses the Platform, including freelancers and clients.

- **"Freelancer"** refers to a user who offers services on the Platform.

- **"Client"** refers to a user who hires freelancers through the Platform.

- **"Services"** refer to the work performed by Freelancers for Clients.

- **"Gig"** refers to a specific job or task posted by a Client.

**3. User Eligibility**

Users must be at least 18 years old to register and use the Platform. By using the Platform, you represent that you meet this age requirement.

**4. Account Registration**

Users must register an account to access the Platform's features. Users are responsible for maintaining the confidentiality of their account credentials. Gigcer reserves the right to suspend or terminate accounts that violate these terms.

**5. Service Posting and Bidding**

- **Clients**: Clients can post Gigs specifying the scope, timeline, and budget. They are responsible for providing accurate and complete information.

- **Freelancers**: Freelancers can bid on Gigs they are qualified to perform. They must ensure that their bids reflect their capabilities and availability.

**6. Contract Formation**

A contract is formed between the Client and Freelancer once the Client accepts a Freelancer's bid. Gigcer is not a party to the contract and does not assume any responsibility for the work or payments.

**7. Payments**

- Payments are processed through the Platform. Clients must deposit the agreed-upon amount into escrow before work begins.

- The Freelancer will receive payment once the Client approves the completed work.

- Gigcer may charge a service fee on transactions, which will be deducted from the payment.

**8. Dispute Resolution**

In case of disputes between Clients and Freelancers, Gigcer offers mediation services. If the dispute cannot be resolved, the matter may be escalated to binding arbitration, as per the laws applicable to the platform's jurisdiction.

**9. Intellectual Property Rights**

All intellectual property rights for the work delivered by Freelancers remain with the Freelancer until full payment is made by the Client. Upon payment, these rights transfer to the Client, unless otherwise agreed.

**10. User Conduct**

Users agree to:

- Provide accurate information.

- Respect other users' rights and privacy.

- Comply with applicable laws and regulations.

- Refrain from posting or sending content that is offensive, illegal, or violates any third-party rights.

**11. Termination**

Gigcer reserves the right to terminate any account that violates these terms or engages in conduct harmful to the Platform or its users.

**12. Limitation of Liability**

Gigcer is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform. The Platform is provided "as is," and Gigcer disclaims all warranties, express or implied.

**13. Amendments**

Gigcer may amend these Terms and Conditions from time to time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the amended terms.

**14. Governing Law**
